Who can create a living will?

Similar to the execution of the will, creating a living will involves multiple facets. A few of the aspects of making a living will are provided here. §4670 of the Probate Code in California mentions that the supplying of personal direction, through writing or speech, regarding the person's health care is allowed if it was made by someone older than 18 who is competent and understanding of the law regarding it. The person is able to restrict the directions to be only implemented in a situation or circumstance that was stipulated.

§4673 stipulates what is necessary for a living will to be considered acceptable in terms of the law, and §4674 details the stipulation of the signatures provided of the individuals, that are observers that can testify. According to §4676(a), living wills and the like that are completed at a different state as well as location of authority, abiding to the location's or California's legal requirements, California will apply and legally accept the living will just like if the living will had been completed in California.

Unless otherwise noted conflicting to this, one of the following is able to believe or conjecture the living will is legally accepted - regardless of the location it was carried out, as §4676(b) notes:

  • Doctor
  • Doctor's office
  • Hospital
