Guardianship is when an individual is responsible for taking care of a deceased individual's children that are younger than 18, or other individuals who are unable to take care of themselves - a guardian can also be assigned to care for the individual's property.

If an individual chooses an individual to care for their children or belongings that are not family members, the requirements for such are listed in §1540-1543.

Understanding Guardianship Laws

According to probate code §1500, the mother or father of a child can designate another individual with custody to care for their children or another individual that needs care - guardianship can also be granted for the care of the individual's property and belongings.

This is only applicable if:

  • The second spouse is in agreement with the designation
  • The second spouse also designates the individual
  • The designation for said individual occurs when the second spouse doesn't have the rights to give agreement
  • The second spouse has passed away
  • The child was adopted
